1. Introduction

Welcome to OURTOR ("we," "our," or "us"), operated by OURTOR TECH LTD, a company registered in England and Wales (company number 12540127). These Terms of Service ("Terms") govern your access to and use of the OURTOR platform, including our website, mobile applications, and services (collectively, the "Service").

Important: By accessing or using the Service, including by tapping "I agree and continue" in the app, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

When you agree in the app we keep a record of the version you agreed to and when, linked to your account, as evidence of your agreement.

When you download OURTOR from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies. These Terms are between you and OURTOR TECH LTD only; Apple and Google are not parties to them and are not responsible for the Service, its content, or support.

2. Eligibility

You must be at least 13 years old to use our Service. By using our Service, you represent and warrant that you meet all eligibility requirements that we outline in these Terms. If you are under the age of majority where you live, you confirm that a parent or guardian has reviewed these Terms with you.

3. Accounts and Guest Use

You can open OURTOR and explore places and published travel stories without entering a name or email address. In that case the Service identifies your device with an anonymous device identifier so that your progress, purchases and settings can be kept. You may add and verify an email address at any time, which lets you reach your account and purchases from other devices. Some features, such as posting, commenting, and adding friends, need a verified email address.

When you provide information to us, it must be accurate, complete, and current. Failure to do so is a breach of these Terms and may result in suspension or termination of your account.

  • Tell us promptly about any unauthorised access

You can delete your account at any time under Settings → Your Data → Delete Account, or at ourtor.com/delete-account. Deletion follows the 30-day grace period described in our Privacy Policy. Deleting your account ends your access to anything tied to it and does not entitle you to a refund of purchases already made.

4. User Content and Community Safety

OURTOR has zero tolerance for objectionable content or abusive users. Harassment, hate speech, threats, sexual exploitation, graphic violence, and illegal content are prohibited.

Use Report on content or profiles to alert our moderation team, and Block to immediately hide an abusive user's content. Blocks also notify our moderation team. Reported content is hidden from other users while we review it promptly; we then remove objectionable content and suspend or terminate the accounts responsible for abuse, or restore the content if the report is not upheld. Text posted in posts and comments is also checked automatically.

Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, photos, videos, or other material ("User Content"). You keep ownership of your User Content and are responsible for it, including its legality, reliability, and appropriateness. You grant OURTOR a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, and distribute your User Content within the Service, solely so that we can operate, promote, and improve the Service. This licence ends when you delete the content or your account, except where the content has been shared with others who have not deleted it, or where we must keep it by law.

5. AI Features

Some optional features of the Service, such as the AI guide and AI-assisted story and content tools, use third-party AI services to produce responses and content. Before an optional feature first shares your information with an AI service, the app explains what is shared and asks for your permission. You can change these choices at any time under Settings → Privacy → AI features, and you can keep using the rest of OURTOR without enabling them. Our Privacy Policy describes the information shared, the services involved, and how long it is kept.

AI-generated content can be inaccurate, incomplete, or out of date. It is provided for general interest and inspiration, is not professional advice, and should be checked before you rely on it, particularly for opening times, access, safety, or legal requirements. You remain responsible for anything you choose to publish, including content you created with AI assistance.

6. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of OURTOR and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial purposes in line with these Terms.

7. Purchases and Subscriptions

Some parts of the Service are paid. These include one-time purchases, such as energy recharges and passes, and the OURTOR Limitless auto-renewing subscription. Purchases are made through your Apple ID on the Apple App Store, or through Google Play on Android, and are subject to that store's terms. Prices are shown in the app in your local currency before you confirm.

Auto-renewing subscriptions

  • Payment is charged to your store account when you confirm the purchase.
  • A subscription renews automatically at the price shown, for the same period, unless you cancel at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours before the end of the current period.
  • You can manage or cancel a subscription at any time in your Apple ID or Google Play subscription settings. Deleting the app or your OURTOR account does not cancel it.
  • Any unused part of a free trial ends when you buy a subscription, where a trial is offered.

Refunds are handled by Apple or Google under their own policies; we cannot issue refunds for store purchases directly. Purchases can be restored on a new device from the Store screen using the same store account, and adding a verified email address to your OURTOR account makes that easier. Digital items have no cash value and cannot be transferred or sold. If we believe a purchase is fraudulent or high-risk, we may ask for additional information to verify it.

8. Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

Prohibited activities

  • Illegal activities: In any way that violates any applicable national or international law or regulation.
  • Harm to minors: For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
  • Inappropriate content: To transmit any material that is defamatory, obscene, offensive, or otherwise objectionable.
  • Impersonation: To impersonate or attempt to impersonate OURTOR, an OURTOR employee, another user, or any other person or entity.
  • Misuse of location: To fake your location, or to interfere with how discoveries, rewards, or leaderboards are earned.
  • Automated access: To scrape, reverse engineer, or access the Service by automated means, or to probe or bypass its security.
  • Service disruption: To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which may harm OURTOR or users of the Service or expose them to liability.

9. Suspension and Termination

We may suspend or terminate your access to the Service, remove content, or restrict features immediately and without prior notice if you breach these Terms, if we receive a credible report of abuse or objectionable content, if we are required to by law, or if your use creates risk or legal exposure for OURTOR or other users. Where it is reasonable to do so, we will tell you why. You may stop using the Service or delete your account at any time. Sections that by their nature should survive termination, including those on User Content, intellectual property, disclaimers, liability, and governing law, will continue to apply.

10. Travel and Location Safety

OURTOR encourages you to explore real places. You are responsible for your own safety and for obeying the law, local rules, and the wishes of landowners wherever you go. Do not trespass, enter restricted or unsafe areas, or look at your phone while driving or in hazardous surroundings. Map, opening-time, and access information may be incomplete or out of date, so confirm it before you travel.

11. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we do not warrant that the Service will be uninterrupted, error-free, or that content is accurate or complete. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for any rights you have as a consumer.

Subject to the above, in no event shall OURTOR, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service, including AI output
  • Unauthorized access, use, or alteration of your transmissions or content

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions, and without affecting any mandatory consumer rights you have in the country where you live. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will ask you to review and agree to the updated Terms in the app, and we will try to provide at least 30 days' notice before they take effect. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.
